Welcome to MudhaPlum! These Terms and Conditions govern your use of our food ordering and delivery platform. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account, placing an order, or using any part of the MudhaPlum platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
If you do not agree with any part of these terms, you must not use our services.
2. User Eligibility
- You must be at least 18 years old to use our services
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must not share your account with others
- You agree to notify us immediately of any unauthorized use of your account
3. Orders and Payments
Placing Orders
- All orders are subject to acceptance by the restaurant
- Restaurants reserve the right to refuse or cancel orders at their discretion
- Prices are displayed in US Dollars and may be subject to change
- You are responsible for ensuring delivery address accuracy
Payment Methods
We accept the following payment methods:
- EcoCash mobile money
- OneMoney mobile money
- Innbucks
- Cash on Delivery (where available)
Payment Terms
- Payment is due at the time of order placement or upon delivery
- All mobile money transactions are processed securely through verified payment gateways
- You authorize us to charge the selected payment method for the order total
- Failed payments may result in order cancellation
4. Delivery Services
- Delivery times are estimates and may vary due to traffic, weather, or restaurant preparation time
- Delivery fees are charged per restaurant and displayed before order confirmation
- You must be available at the delivery address during the estimated delivery window
- We are not responsible for delays caused by incorrect addresses or unavailability
- Our delivery partners will attempt contact via WhatsApp or phone if unable to locate you
- Failure to accept delivery may result in order cancellation without refund
5. Cancellations and Refunds
Customer Cancellations
- Orders can be cancelled within 5 minutes of placement without penalty
- After 5 minutes, cancellations are subject to restaurant approval
- If the restaurant has already started preparing your order, you may be charged
Restaurant Cancellations
- Restaurants may cancel orders due to ingredient unavailability or other reasons
- You will be notified immediately and receive a full refund
Refund Policy
- Refunds are processed within 3-7 business days
- Refunds are issued to the original payment method
- You must report issues within 24 hours of delivery
- Partial refunds may be issued for missing or incorrect items
6. Food Safety and Quality
- All restaurants on our platform are verified for basic food safety standards
- Restaurants are solely responsible for food preparation and quality
- We act as an intermediary and do not prepare food ourselves
- Report any food safety concerns immediately to our support team
- In case of foodborne illness, please contact both us and local health authorities
7. Prohibited Activities
You agree not to:
- Use the platform for any illegal or unauthorized purpose
- Place fraudulent orders or use invalid payment methods
- Abuse, harass, or threaten restaurant staff or delivery partners
- Provide false information or impersonate others
- Attempt to access unauthorized areas of the platform
- Use automated systems or bots to interact with our services
- Share your account credentials with others
- Post offensive, defamatory, or inappropriate reviews
8. Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms and Conditions
- You engage in fraudulent activity
- You abuse our platform, staff, or partners
- You have unpaid orders or chargebacks
- We suspect unauthorized account access
You may also request account deletion at any time by contacting our support team.
9. Limitation of Liability
To the maximum extent permitted by law:
- MudhaPlum is not liable for any indirect, incidental, or consequential damages
- Our total liability for any claim is limited to the amount paid for the specific order
- We are not responsible for restaurant errors, food quality issues, or preparation
- We are not liable for delays caused by third parties or circumstances beyond our control
- Use of our platform is at your own risk
10. Intellectual Property
- All content on the MudhaPlum platform is protected by copyright and trademark laws
- You may not copy, reproduce, or distribute our content without permission
- Restaurant logos, images, and menus are property of respective restaurants
- User-generated content (reviews, photos) may be used by us for promotional purposes
11. Restaurant Partners
For Restaurant Partners:
- You must maintain all required food safety licenses and permits
- You are responsible for accurate menu information and pricing
- You must honor orders placed through our platform
- You agree to our commission structure and payment terms
- You are responsible for food preparation, quality, and packaging
12. Delivery Partners
For Delivery Partners:
- You must have a valid driver's license and vehicle registration
- You are responsible for safe and timely deliveries
- You must maintain professional conduct with customers
- You agree to our delivery fee structure and payment terms
- You are an independent contractor, not an employee
13. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.
14. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our platform. Your continued use of our services after changes constitutes acceptance of the modified terms.
We will notify users of significant changes via email or platform notifications.
15. Governing Law and Dispute Resolution
- These terms are governed by the laws of Zimbabwe
- Any disputes shall be resolved in the courts of Zimbabwe
- We encourage resolution through our customer support before legal action
- You agree to attempt mediation before pursuing litigation
